This page is responsible for providing you information regarding our terms and conditions that are applied to services and processes such as; sales, repairs, shipping and delivery, payment terms and methods, return and refund procedures, our website usage and conduct, copyright and intellectual property, limitation of liabilities, and more. 

 

We did our best to format it in a way that is easily readable, clear, and accessible to you while minimizing the legal-ese since it’s common practice for companies to lose you a sea of words. DEFINITIONS 

Our terms and conditions will use substitute words or acronyms to improve readability. Such words and their definitions will be outlined in this section of the agreement.

- "You", "Customer" is in reference to the party who is agreeing to the terms and conditions 

- "Us", "We", "Our" is in reference to Fox Technologies as a business entity 

- "ETA" is in reference to estimated or approximate time-frames 

- "Relationship" is in reference to a series of agreements between Fox Technologies and the consenting party 

- “Service” and “Product” is interchangeably in reference to the things we provide you or sell to you

- "Personalized" is in reference to items or orders that are customized or modified at the request of the customer

AGREEMENT TO FIRST-PARTY AND THIRD-PARTY TERMS 

These terms apply to any purchase or service you place with us on or after the effective date shown at the top of this page. You also agree that you understand the terms within the agreement and are responsible for requesting clarification if a part of the agreement is not understood. We may update these terms from time to time. If a change is material, we will notify you using your contact information on file. The updated terms will apply to future purchases/services after the update date. If you continue with a new purchase/service after the update, that counts as acceptance.

 

These terms include the policies linked at the top of this page (Privacy Policy, Repair Policy, Warranty Policy, and Platform Terms). If there is a conflict, the most specific policy for the situation controls (for example, the Repair Policy controls repairs). By acknowledging this, you agree to the terms outlined in the referenced documents.

 

Fox Technologies reserves the right to terminate any services and agreements in the event that our terms have been violated, or you no longer agree to the terms outlined to you at any time. We also reserve the right to terminate any services and agreements without providing a reason for termination, but not without notice to you. 

 

These terms are governed by the laws of the state where our business is located, plus applicable federal law. However, you are responsible for ensuring that you are in compliance with laws that are applicable to you. You may have certain rights under applicable laws in your jurisdiction. No terms provided are intended to affect those rights, if it applies.

 

By providing our services to you, you may be subject to conditions outlined by third-party entities, such as repair policies from partnering companies, terms and conditions from developers of software we sell to you, or terms and conditions that belong to third-party services we leverage in order to provide you with a service. While we will do our best to ensure that these conditions are in good faith and that you are aware of them, you agree that you are in compliance with the conditions set by the third-party and that we bear no responsibility of termination or violations. We are not obligated to inform you of any changes to third-party terms or conditions.

PRODUCTS AND SERVICES 

We offer to our customers brand new, renewed and refurbished electronics, electronic accessories, electronic parts and components, software licensing, device insurance plans, informational services, and repair services. Our sales, shipping, and services are currently offered within the United States only. In order to establish a relationship with us, we require that you are at least: 

i.) 16 years old with written or explicit permission from a parent or guardian to purchase goods and services from us 

ii.) 18 years or older 

 

If we require any signatures or approval for agreements that are legally binding and you are under the age of 18, we reserve the right to request signatures and approval from a legal parent or guardian prior to providing our services to you.

Some of our services offer advice and consultation from technology professionals. This information is provided to you using available resources. While we try our best to make sure that the information provided to you is accurate and up-to-date, some information provided may have inaccuracies or contain mistakes. When receiving guidance from our professionals, you understand and accept the possibility of such information.

"AS-IS" AND PERSONALIZED PRODUCTS

"As-is" products are products in which the customer accepts the goods in their current state. This includes all installed components and software, physical and cosmetic condition, and integrity of the product. "As-is" products are not obligated to receive on-going support by Fox Technologies.

Some services and products we offer to you may be personalized at your request. This may include services such as custom computer builds or existing product modifications. These products may be subjected to their own unique conditions and are automatically considered to be "as-is" products upon customization.

PAYMENT TERMS 

When purchasing goods and services, all payments are required to be provided in the form of digital payments via. credit and debit cards, Apple Pay, Cash App, Paypal, cryptocurrency, or bank ACH and wires. Cheques are not accepted.

You may be provided with a digitally or physically delivered invoice that contains a balance. All invoices are required to be paid in full and within their specified due-by date. This is also applicable to special agreements, such as NET-15 or NET-30 payment agreements.

Delivery of goods and services may be withheld or delayed if a due payment is pending or has not been processed. Delivery will proceed once there is confirmation that a payment has been completed. If there are any delays or issues with processing your payment, you will be notified. By acknowledging this, you agree to be responsible for ensuring funds are available for withdrawal and that you have taken appropriate measures to facilitate the transfer of currency.

Some services, such as â€‹consultation or repair services, may require minimum commitment payments or deposits. If such payment is required, you will be notified.

All payments are processed by "Square”, a product of Block, Inc. Payment processing fees, banking fees, merchant fees, and credit card transaction fees may apply.

INFORMATION PROVIDED BY YOU 

In order for us to identify you as a customer, process your payments, and be able to provide our products to you through mailing or digital delivery, you may be required to provide us with information such as your name, telephone number, e-mail address, physical address to a residence or business, card information, banking information, and other information that may apply to a transaction, identification, or delivery. All of this information will be protected by our Privacy Policy, in which you are required to read to understand your rights and how your information is handled by us. 

 

You are responsible for ensuring any information you provide is legal, up to date, in good faith, and good standing. You have the right to anonymize or omit sensitive information as outlined in our Privacy Policy, but this may cause problems or unintended consequences if the information is inaccurate or not verifiable. We may have problems contacting you, delivering goods and services, or processing transactions. You acknowledge that you are responsible for correcting these problems if they occur and that we are not liable for any issues that arise from anonymization.

COMMUNICATIONS 

Our usual contact and notification method is through e-mail, however we do occasionally offer telephone or letter communication. SMS or text messaging communications is not available and will not be attempted by us, although these services may be provided by a third-party. We will attempt to reach you through your provided methods of contact. If we cannot reach you or do not receive effective responses to correspondence attempts, this may affect our ability to service you and can risk reducing quality of service.

 

If we do not receive effective communications or responses from you despite multiple attempts to contact you, we do not assume any responsibility for degradation in quality or potential losses and damages as a result of lack of communication.

SHIPPING AND DELIVERY TERMS 

Shipping and delivery of goods and services are only available within the US. We do not ship internationally (for now!). 

 

In order to deliver goods to you, we may use third-party courier services such as UPS, USPS, FedEx, or other available methods of delivery. Prior to shipping, an ETA will be provided to you for the arrival of your order to your address on file. Shipping and delivery times are estimated and are subject to change. When your product is ready to be shipped, a tracking number will be provided to you through e-mail along with information associated with your order. It is encouraged to contact the courier to address any issues regarding the receipt of your order. 

 

Costs of packaging and shipping, shipping fees, protection services and insurance, and other applicable costs may apply to your total charge at the time of purchasing goods and services, and are nonrefundable. If an order you have purchased has never been received, or has arrived damaged, please contact us as soon as possible at support@foxtechnologies.org.

These terms are also applicable to our mail-in repair service.

RETURNS AND REFUNDS 

We accept returns on used, opened, or refurbished goods. Returns are approved only for the following reasons: the wrong item was shipped to you, an item is missing a key feature we advertised, or defective hardware within the effective return window. We do not accept returns or issue refunds for software licenses, digital keys, or other licensing developed by third-parties. Refunds are not applicable to commitment fees or labor charges in services such as consultation time, repairs, or refurbishing projects. Refunds do not apply to transaction fees charged by payment processors or financial institutions. Approved returns may have a restocking fee of up to 35% depending on condition and return shipping/processing costs.

 

If you need to return a product, please contact us at support@foxtechnologies.org. All returns must be accompanied by the original receipt and must be in its original condition, including all materials, packaging, manuals, warranty cards, paperwork and documentation, and accessories. 

 

Repeated returns may result in flagging of your account, to which the right to return and refunds may be revoked and becomes subject to review. If return activity is determined to be fraudulent or unreasonable, the right to return may be permanently revoked with notice to you.

 

At times, we may issue a credit or a discount to you if a refund cannot be provided or if a return does not meet criteria for a refund. This credit or discount can be applied to your next purchase and does not expire. Once a credit or discount has been used, it is not reusable. Credit does not scale or change in value.

 

WEBSITE USE AND USER CONDUCT 

Upon registering to our website or any social media services that we provide to you, you are in automatic agreement to our Platform Terms and Conditions as well as any agreements provided by third-party platform hosts and services. If at any point these terms and conditions are violated or you no longer agree to them, we reserve the right to terminate your access and close your account with notice to you.

 

Any credit, discounts, or offers applied to your account will no longer be accessible and cannot be transferred. Fox Technologies is not obligated to provide any compensation or on-going support for closed accounts.

WARRANTIES AND DISCLAIMERS

Fox Technologies, as well as its subsidiaries and partners, disclaim all representations and warranties of any kind. We make no warranties that: our services will meet your requirements, will be uninterrupted, timely, secure, or error free, the results that may be obtained are accurate or reliable, the quality of services or information obtained by you through the usage of our services will meet your expectations, that any errors in the services will be corrected, or in reference to payments of refunds, the timeliness of such payment will meet your expectations.

RISK AND LIMITATION OF LIABILITY 

While we do our best to provide you with trustworthy equipment, information, and software, there is always risk involved in interacting with technology or handling of services that are provided by others. Such risks may involve failure of hardware, software bugs or glitches, inaccuracies in data or information, inconsistencies in quality, incompatibility of hardware, defects, losses or lack of communication, or changes in security. "As-is" and personalized products are subject to these same risks.

Certain services such as repairs or warranty processes may require, or incur, cosmetic or physical damage or changes to your device. Such changes and damages may include; disabling of device encryption or security changes, blemishes, bruising, scrapes, scratches, dents, warping, rubber feet or adhesive removal, chipping, or electrical shorting. We have procedures in place to do our best to prevent these situations from occurring, but there may be unavoidable circumstances (e.g, age or conditions of device, build quality, etc.) that are beyond the reasonable control of Fox Technologies. You accept the risk that such damages or changes may occur.

Under no circumstance is Fox Technologies responsible for; the backup, recovery, or loss of information or data, financial damages, physical damage to personal items or equipment, or damages as a result of changes in your personal security. This also includes any damages that are incurred as a result of changes to anti-virus security, exposure to scammers, hackers, or any other vulnerability as a result of change to security. 

 

At times, such as during repair processes, you may be requested to provide passwords, passphrases, encryption keys, activation keys, or any other credential to permit access to perform work or maintain accessibility. If you fail to provide any required information, we are not responsible for data loss due to the loss of access, or loss of access in its entirety. Device encryption and the handling of security policies are the liability of the customer. 

 

We may be requested to engage with technology that is antiquated and considered legacy. In such cases, we are not obligated to provide on-going support for any legacy systems that cannot be sufficiently supported at the discretion of Fox Technologies. We are not responsible for any risk or damages associated with the handling or operating of legacy systems. 

 

We may be provided with third-party software that comes with its own support agreement and terms. We are not obligated to provide on-going support for any services, subscriptions, or software that has been installed or setup at the request of the customer. This limitation of support also applies to the installation and management of modern software.

We are not responsible for any violations of laws or regulations within, or outside of reasonable means that are applicable to your organization or affiliations. You are responsible for ensuring you are in compliance with aforementioned laws and regulations when using our services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOX TECHNOLOGIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING THE LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION. FOX TECHNOLOGIES DOES NOT PROVIDE LEGAL, FINANCIAL, OR REGULATORY ADVICE.

To the maximum extent allowed by law, you agree to release and hold harmless Fox Technologies from claims arising from the risks described in these terms.
